MOA COMMUNITY FOUNDATION
FESTIVAL OF TREES RAFFLE
HOUSE RULES
1. ELIGIBILITY. MOA Community Foundation Festival of Trees Raffle (the “Raffle”) is conducted in the State of Minnesota in accordance with these House Rules and is only open to participants who, as of the entry date, are at least eighteen (18) years old. Executives, officers, senior management, board members and directors of MOA Community Foundation, their affiliates, and their immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such executive, officer, senior manager, board member, or director, are not eligible to enter. Employees and volunteers of the Festival of Trees tasked with the selection of Prize Winners and their immediate families (as defined above) or members of the same household (whether related or not) of each such employee and volunteer are not eligible to enter.
2. LICENSE. The Raffle is conducted by MOA Community Foundation, a non-profit charitable organization in the State of Minnesota (the “Organization”). The address at which the Organization may be contacted is: MOA Community Foundation, 2131 Lindau Lane – Suite 500, Bloomington, MN 55425. The Raffle is conducted pursuant to Minnesota Lawful Gambling Permit X-95387-24-001, a copy of which is posted at the premises where the Raffle is conducted.
3. HOW TO ENTER/RAFFLE DATE AND PERIOD.
a. Sales and Sales Period. Raffle tickets will be physically sold at Mall of America in Bloomington, Minnesota (“MOA”) at locations designated for the sale of Raffle tickets during the Festival of Trees event (“Event”) at MOA, located at Level 3, Culinary on North. Hours of the Event are as follows:
November 15-December 9:
- Sunday: 12:00 p.m. CST - 7:00 p.m. CST
- Monday + Tuesday: Closed
- Wednesday-Saturday: 12:00 p.m. CST - 8:00 p.m. CST
December 10-January 3:
- Sunday: 12:00 p.m. CST - 7:00 p.m. CST
- Monday-Saturday: 12:00 p.m. CST - 8:00 p.m. CST
Holiday Hours
- November 23 (Thanksgiving): Closed
- November 25 (Black Friday): 7:00 a.m. CST – 8:00 p.m. CST
- December 24 (Christmas Eve): 12:00 p.m. CST – 6:00 p.m. CST
- December 25 (Christmas): Closed
- December 31 (New Year’s Eve): 12:00 p.m. CST – 6:00 p.m. CST
- January 1 (New Year’s Day): 12:00 p.m. CST – 6:00 p.m. CST

b. Purchase Requirements and Prices. One (1) Raffle ticket is purchased for a price of $10.00. Only one (1) ticket is required to be purchased by an eligible individual to enter the Raffle; however, there is no limit to the number of Raffle tickets an eligible individual may purchase.
c. How to Enter. Eighty-two (82) trees will be decorated by donors at the Event. Raffle Entry Boxes (each an “Entry Box”) will be placed in front of each decorated tree and will have information about the approximate value of the Prize, and the sponsor or donor logo. To enter to win a Prize, Raffle ticket purchasers must put a ticket into the Entry Box of the tree that they wish to win the decorations from. Each entrant has an equal chance to win the Prize for which they submit a Raffle ticket.
d. Raffle Ticket Retention. A Raffle ticket purchaser will be given the Raffle ticket(s) at the time of purchase. A digital record of the Raffle ticket will be retained by the Organization.
e. Valid Payment. Raffle tickets may be purchased with cash, debit card, and credit card only. Raffle tickets may not be purchased with personal checks. Raffle tickets may be sold only for the price printed on the ticket, and may not be re-sold, provided free of charge, or provided for any other consideration.
4. PRIZE; PAYMENT. The Raffle prizes (each a “Prize”) are the donated decorations placed on the trees at the Event. The Prize specifications are listed in the chart below:

To claim a Prize, Prize Winners (each a “Prize Winner”) must satisfy all terms and conditions of these Official Rules, including return of all forms and documents, as defined in Section 5(b) below, to the Organization. The Prize Winner is required to be at least eighteen (18) years of age. Organization may be required to withhold federal taxes in accordance with federal and state laws and regulations, and if required, will do so as a pre-condition of awarding the Prize. Prize Winner is solely responsible for any and all costs, fees, taxes, or expenses associated with the Prize award, receipt and use, including, without limitation, all federal, state and local taxes on the Prize. Prize Winner will be required to complete an IRS Form W-9 and may be issued an IRS Form 1099 for the amount of the Prize.
5. DRAWING; NOTIFICATION; REDEMPTION; VERIFICATION ODDS.
a. Drawing and Notification. One (1) winning Raffle ticket will be randomly drawn from each Entry Box for each tree by the Organization at MOA at 12:00 p.m. CST on January 4, 2024 for selection of the Prize Winners. The Prize Winners must confirm with the Organization that they will claim the Prize within 72 hours of receiving notice from the Organization that they were selected as a Prize Winner. If a Prize Winner does not confirm its intent to pick up the Prize with the Organization, the Organization will redraw for a new Prize Winner. If no tickets are put into an Entry Box for a certain tree, the decorations from said tree will be returned to the organization that donated the decorations. The winning Raffle ticket number will be (i) displayed on online (https://mallofamerica.com/node/27485) for a period of sixty (60) days after the drawing. The Prize Winners do not need to be present at the drawing to win. The Prize Winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.
b. Redemption. To claim the Prize, a holder of a winning Raffle tickets must go in person to MOA Level 3 North on Friday, January 12 from 3:00 p.m. CST to 7:00 p.m. CST, or on Saturday, January 13th from 12:00 p.m. CST to 3:00 p.m. CST. A potential Prize Winner will be required to provide to the Organization (i) a photo ID, (ii) when applicable, an IRS Form W-9 in the form provided by the Organization, (iii) when applicable, an IRS Form W-2G and/or Form 1042S (requires two forms of identification) in the form provided by the Organization, and (iv) a General Release & Waiver provided by the Organization releasing the Organization and their respective agents, employees, supplies, and advertising/promotional and judging agencies, Facebook, Instagram, Meta, Twitter, Tik Tok, and each of their respective parents, affiliates, subsidiaries, from any and all liability whatsoever for injuries, damages or losses to persons and/or property which may be sustained in connection with the Raffle or the Prize. The IRS Form W-9, and if applicable the Form W-2G must be executed and delivered at the time of surrender of the original winning Raffle ticket.
c. Verification. The winning Raffle tickets are subject to verification at the sole discretion of Organization. Raffle tickets that are stolen, counterfeit, fraudulent, tampered with, defective, illegible, reproduced (including without limitation, copies), mutilated, or altered are not eligible. Only Raffle tickets obtained as described in these Official Rules shall be deemed to have been obtained legitimately. Anti-fraud detection devices may be used for verification purposes. Raffle tickets will be void if they fail to pass anti-fraud detection measures, or, if determined by the Organization to be unauthorized, ineligible, illegitimately obtained, or if they contain an unauthorized message, code, number or other marking not issued by the Organization for use in the Raffle, or if they contain printing, typographical or other mechanical errors or are printed or produced in error, or are illegible, or unreadable or blank. The Organization shall have no liability or obligation to the holder of any void Raffle ticket. Notwithstanding the foregoing, the Organization may, at its sole discretion and without obligation, elect to replace a void Raffle ticket with another one upon request. The Organization reserves the right to inspect and examine any void Raffle ticket prior to issuing a replacement. Replacements will be issued at the Organization’s sole discretion and will be denied in the event of non-compliance with these Official House Rules. The Organization is not responsible for lost, damaged or stolen Raffle tickets, and will not replace or reissue lost, damaged or stolen Raffle tickets.
d. Surrender. If a potential Prize Winner does not execute and deliver to the Organization an IRS Form W-9 or W-2G, as applicable, as provided above before the end of the redemption of the prize, or if the potential Prize Winner is found to be ineligible, or if the potential Prize Winner does not comply with the Official Rules, then the potential Prize Winner may be disqualified and the Prize forfeited.
e. Multiple Prize Winners – Mistake. If by reason of printing or other error, more than one Prize winning Raffle ticket number is selected for any one Prize, all eligible participants making purportedly valid claims for the Prize will be included in a random drawing to award the Prize. Inclusion in such drawing shall be each participant’s sole and exclusive remedy under such circumstances.
6. AGREEMENT TO OFFICIAL RULES AND DECISIONS. By participating in the Raffle, each Raffle ticket purchaser fully and unconditionally agrees to be bound by and accepts these House Rules and the decisions of the Organization (including, without limitation, decisions regarding eligibility of Raffle tickets, the verification of the winning Raffle tickets, and the redemption and award of the Prizes), which are final and binding in all respects.
7. PUBLICITY. Except where prohibited by law, participation in the Raffle constitutes the Prize Winner’s consent to use by the Organization and MOAC Mall Holdings d/b/a Mall of America (and their respective designees, successors and assigns) of a Prize Winner’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice, review or consent.
8. GENERAL CONDITIONS. The Organization reserves the right to disqualify any individual it finds to be tampering with the Raffle process or the operation of the Raffle or to be acting in violation of these House Rules, or Minnesota statute or rule. Any attempt by any person to undermine the legitimate operation of this Raffle is a violation of criminal and civil laws, and, should such an attempt be made, the Organization will contact law enforcement and reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
9. CHOICE OF LAW AND JURISDICTION. Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these House Rules, or the rights and obligations of entrants, the potential winners and Organization in connection with any Raffle, shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Minnesota or any other jurisdiction) that might otherwise cause the application of the laws of any jurisdiction other than the State of Minnesota. Any action seeking legal or equitable relief arising out of or relating to any Raffle or these House Rules shall be brought exclusively in the courts of the State of Minnesota located in Hennepin County.
10. HOUSE RULES. These House Rules are available for review and posted conspicuously at the Raffle check-in at Mall of America or a copy can be obtained by sending a self-addressed postage-stamped envelope to “Festival of Trees Raffle” attn: MOA Community Foundation, 2131 Lindau Lane – Suite 500, Bloomington, MN 55425, or at https://mallofamerica.com/node/27485.
11. WINNERS’ LIST. To request a list of Prize Winners’ names, send a self-addressed postage-stamped envelope to “Festival of Trees Raffle - Winner List Request,” attn: MOA Community Foundation, 2131 Lindau Lane – Suite 500, Bloomington, MN 55425. Requests must be received within ninety (90) days of the conclusion of the Raffle.
