Official Rules

  1. Eligibility. The Play at MOA® Promotion (“Promotion”) is only open to Entrants who are legal residents of the United States and are at least eighteen (18) years old on the date of entry. Employees, officers and directors of MOAC Mall Holdings LLC d/b/a Mall of America (collectively, “Sponsor”) and its respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to enter. The Promotion, and any website pages and advertisements relating thereto, are intended for viewing only within Minnesota, and Entrants must be physically present at the Mall of America in Bloomington, Minnesota, (“Mall of America”) at the time they enter.
  2. Promotion Dates. The Promotion entry period begins at 10:00 AM CDT on June 3, 2024 and ends at 9:00 PM CDT on August 30, 2024 (“Promotion Period”).
  3. Participating Tenants. The Sponsor has selected four tenants to operate individual contests under the terms of this Promotion (each, a “Contest”). The participating tenants are: ClimbZone Minneapolis L.L.C. DBA ClimbZone (“ClimbZone”), Xcite Entertainment LLC DBA The Fair on 4 (“The Fair on 4”), Great Big Game Show Minneapolis, LLC (“Great Big Game Show”), and Moose Mountain Adventure Golf, a DBA of MOAC Mall Holdings LLC (“Moose Mountain”). Each operator of a Contest shall be referred to as a “Tenant” and collectively, the “Tenants”.
  4. How to Enter. An individual may enter the Promotion by engaging in one or more skill-based contests based on attractions operated by each of the participating Tenants during the eligible Contest timeframes for each attraction (each, an “Entrant’). Entrant agrees to pay the fees charged by the Tenant as a requirement to participate in each attraction. Entrant agrees to sign any participation agreements or waivers required by each Tenant as a requirement to participate in each attraction. Entrant must provide all required information for a valid entry, including full name, phone number, and email address. Entrant agrees to comply with the rules and regulations of the Tenant’s attractions and the rules of the Promotion. Entrant may participate in specific attractions multiple times during the Contest eligibility period. Entrant consents for Sponsor and Tenant to publicize Entrant’s name and score on a leaderboard that may be displayed publicly at the Mall of America or online. False or deceptive acts by any Entrant, as determined by the Sponsor or a Tenant in their respective sole discretion, will render the Entrant ineligible to participate in the Promotion. Entrant consents to receive emails from Sponsor and Tenant.
  5. Contest Eligibility Dates. The eligibility dates for each Contest shall begin at 10:00 AM CDT on the first day of the Contest eligibility period and end at 9:00 PM CDT on the last day of the Contest eligibility period. The Contest eligibility periods for each Tenant are: ClimbZone from June 17, 2024 to June 24, 2024; The Fair on 4 from July 8, 2024 to July 15, 2024; Great Big Game Show from July 20, 2024 to August 4, 2024; and Moose Mountain from August 5, 2024 to August 9, 2024.
  6. Criteria to Determine Contest Winner. The criteria used to determine the Contest winner for each attraction shall be as follows: ClimbZone: fastest climb up the basketball wall; The Fair on 4: fastest go-kart time; Great Big Game Show: highest trivia score for a single game; and Moose Mountain: longest golf putt with the top three Entrants on the leaderboard competing against each other to determine the Contest winner for the longest golf putt. The winner for ClimbZone, The Fair on 4, and the Great Big Game Show will be the Entrant with the highest score at the end of the last day of each Contest eligibility period. The winner for Moose Mountain will be determined by a final tournament of skill held on August 10 or August 11, 2024 between the top three Entrants on the Moose Mountain leaderboard who agree to return to the Mall of America to participate in the final Moose Mountain tournament. Winners will be determined by each participating Tenant and the determination shall be made solely by clearly demonstrated skills of the Entrants. Any ties between Entrants will be broken on a basis of skill as determined by the Tenant in the Tenant’s sole discretion.
  7. Winner Notifications and Requirements. All winners will be notified via email (to the email address specified in a potential winner’s entry form) within thirty (30) days of the end of the Promotion Period. Except as required to demonstrate their skills in the contests, potential prize winners do not need to be present to win. The potential prize winners will be required to sign and return to Sponsor within forty-eight (48) hours of initial prize notification an Affidavit of Eligibility, General Release & Waiver, Publicity Release (“Affidavit/Release”) in the form or forms provided by Sponsor (where and to the extent legally permissible) in order to be eligible to claim the prize. A prize must be claimed at the place and manner as directed by Sponsor in the prize notification, or the prize may be forfeited. If not disqualified, potential prize winners must continue to comply with all terms and conditions of these Official Rules, and winning and awarding of the prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted directly by Sponsor and/or does not acknowledge notification from Sponsor as required above within forty-eight (48) hours of the first attempt to contact the Entrant, or if any prize or prize notification is returned as undeliverable, or if a potential winner is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner may be disqualified and an alternate winner with the next highest results in the particular Contest shall be selected by participating Tenant as an alternate potential prize winner. In such event, an alternate potential prize winner will be notified as described above and will be required to return the Affidavit/Release to Sponsor as described above. In the event of disqualification of a potential winner, Sponsor will make a reasonable attempt to contact alternate winners as described above; provided, however, Sponsor reserves the right to discontinue such efforts in its discretion and not award the prize. Sponsor is not responsible for the failure of a potential winner to receive any of Sponsor notifications or documents for any reason, or for the inability of a potential winner to respond to any of Sponsor notifications or return any required documents for any reason. Eligibility, age, and other claims of/information provided by a potential prize winner are subject to verification by Sponsor. Entrants must cooperate with Sponsor, in connection with any and all verification activities.
  8. Agreement to Official Rules. By participating in the Contest, each Entrant fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor and Tenants (including, without limitation, decisions regarding eligibility of entries, the selection of Entrants and the winner, and the awarding of the prize), which are final and binding in all respects.
  9. Prizes. Subject to the terms and conditions of these Official Rules, four (4) prizes will be awarded in this Promotion. The prizes will be awarded as follows: a $150 gift card redeemable at participating stores at Mall of America for each winner of the Contests at ClimbZone, The Fair on 4, and the Great Big Game Show. The winner of the Moose Mountain tournament shall receive a $500 gift card redeemable at participating stores at Mall of America. Prizes are nontransferable, nonassignable, nonnegotiable, and not redeemable for cash. Prizes must be accepted as awarded. Winner is solely and fully responsible for any and all costs, fees, taxes, assessments and expenses associated with prize awards, redemptions, receipts and uses, including, without limitation, all federal, state and local taxes on the prizes. If applicable, a winner will be issued an IRS Form 1099 for the actual retail value of the prize. Non-compliance with any of the foregoing provisions and any other condition of this Promotion may result in disqualification and forfeiture of prize, in which case, no consideration will be awarded.
  10. Publicity. Except where prohibited by law, participation in the Promotion constitutes Entrant’s consent to Sponsor and the Tenants (and their respective designees’, successors’ and assigns’) use of Entrant’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, state and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, attribution, notice, review or consent.
  11. General Conditions. Sponsor reserves the right, in its sole discretion, to terminate, modify or suspend the Promotion if, in Sponsor’s opinion, there is any suspected or actual evidence of tampering the operation of the Contest(s) or if an Entrant appears to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision or any other provision of these Official Rules.
  12. Release. By entering and participating in the Promotion, each Entrant forever and irrevocably releases and holds harmless Sponsor, Tenants, and each of its respective parents, subsidiaries and affiliates, and their respective agents, designees, advertising and promotion agencies, affiliates, respective employees, officers, directors, shareholders and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from Entrant’s participation and/or entry in the Promotion or any Contest activities, and/or Entrant’s award, redemption, receipt or use of any prize awarded in the Promotion.
  13. Limitation of Liability. Sponsor is not responsible for (a) the operations of the Contests; (b) printing, typographical, electronic or human errors which may occur in the offer or administration of the Promotion; or (c) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Tenant’s attractions or the Contests.
  14. Disputes. Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prizes awarded or to be awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in federal or state courts located in Bloomington, Minnesota and Entrant submits to sole and exclusive personal jurisdiction to said courts for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant or Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of Minnesota, without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Minnesota, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
  15. Data Collection. Entrants may provide personal information to Sponsor(s) and its designees in connection with this Promotion. For more information about the ways Sponsor uses and shares personal information, please see the Privacy Policy of Sponsor located at https://mallofamerica.com/privacy. In the event of any conflict between the Privacy Policy and these Official Rules, these Official Rules shall govern.
